Federal Spotlight: NLRB finalizes "Ambush Election rule"

On Dec. 12th, the National Labor Relations Board (NLRB) finalized a rule that will impact workplace procedures before a labor election takes place. The rule is commonly referred to as the Ambush Election rule by the National Association of Manufacturers, or NAM.

One change includes requiring personal contact information be included on employee voter lists which are given to the unions. The rule also permits parties to file election petitions and other documents electronically, eliminates an employer’s right to challenge voter eligibility, and forces parties to consolidate all election-related appeals to the Board into a single appeals process.

The NAM intends to file a lawsuit challenging the rule.  To view the full text of the rule, click here.
