ABI files amicus brief in punitive damages case

ABI filed an amici curiae brief with Master Builders of Iowa in a troubling case, Rednet Environmental Services vs. The Hansen Company. In this case, punitive damages were erroneously awarded in a district court construction contract case. In the underlying dispute, a judge allowed punitive damages to be awarded, despite the fact that no tort was committed, the legal requirement to award punitive damages in such breach of contract cases. The brief explains that the effects of this departure from longstanding, understood practices and contract law could be much further reaching than just the construction industry.
